The General Contract Terms and Conditions regulate the distant selling relationship between GT-MEDICAL SL and the User or customer, in accordance with the legal stipulations, in particular, Law 7/1998 of 13 April, on General Contract Conditions, Law 3/2014 of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999 of 13 December, on Personal Data Protection, Law 7/1996 of 15 January, on the Regulation of the Retail Trade and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

GT-MEDICAL SL reserves the right to make any modifications it deems appropriate, without prior notice, to the General Terms and Conditions. These modifications may be made through its websites, by any legally admissible means, and will be binding for as long as they are published on the website and until they are modified through valid means by subsequent modifications. However, GT-MEDICAL SL reserves the right to apply, in certain cases, Specific Contract Terms and Conditions with preference over these General Terms and Conditions when it deems appropriate, announcing them in due time and form.

The purpose of the website is to advertise and sell prosthetic equipment.

The duration of the contract will be related to the delivery of the product, without prejudice to the right of withdrawal. As a user or customer, you expressly declare that you know, understand and accept the terms and conditions of use and these general contract terms and conditions.

Likewise, you declare that you are of legal age and have the legal capacity and capacity to act necessary to access the GT-MEDICAL SL websites and to contract through them. To purchase our products, you can go to the corresponding section of our online store. Once the purchase process has been completed, the customer will receive a confirmation of the purchase by email. It is essential for the User to provide a valid email address during the purchase process. All the contents of the website are in Spanish. Upon receipt of the product at the delivery address provided, the customer will receive an invoice or a copy of the order.

OFFER AND VALIDITY

When a product is on offer, the offer price and the validity of the offer will always be indicated next to the essential characteristics of the product. In compliance with current legislation, GT-MEDICAL SL offers information on all items for sale, their characteristics and prices. However, GT-MEDICAL SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content thereof. Thus, the products offered at any given time on the website will be governed by the General Contract Terms and Conditions in force in each case. The company will also have the right to discontinue, without prior notice and at any time, access to the aforementioned products.

ESSENTIAL CHARACTERISTICS OF THE PRODUCTS

The products offered on our online store include a photograph and the essential characteristics of the product, which is information obtained from the manufacturer. The colour of the product, which can be seen in the photograph, is not binding. It is identified in the characteristics.

WARRANTY

All products offered on the website are covered by the commercial warranty of the supplier of the product. GT-MEDICAL SL provides an after-sales service, while the warranty is in force, which the customer may execute by contacting the GT-MEDICAL SL establishment, the after-sales service, by email at clientes@gt-medical.com or at the points established by the supplier itself. PRICES

All products indicate the sales price in euros and do not include Value Added Tax (VAT). If any other tax is applicable, this would be stated.

DELIVERY AND TRANSPORT COSTS

GT-MEDICAL SL only delivers by courier and charges a delivery fee of 6 or 9 euros. If the order exceeds €50 within Madrid and €100 for the rest of Spain, no delivery charges will be applied. Delivery to the Canary Islands is charged at €25 in all cases. Delivery to Portugal is free of charge for orders over €100.

METHODS OF PAYMENT AND ORDER PROCESSING

All transactions involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) technology. All the information you send to us will travel across the web in code.
Likewise, your credit card details are entered directly on the bank’s website, at the bank’s POS (Point of Sale) and are not entered or registered on any GT-MEDICAL SL server.
When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiry date and a validation code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus providing the transaction with further security guarantees.
This payment method is only valid on the website.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In this case, the corresponding debit and credit entries will be made on the accounts of the supplier and the holder as soon as possible.
However, if the purchase has actually been made by the cardholder and the demand for a refund is not the result of having exercised the right of withdrawal or termination and, therefore, the cancellation of the corresponding charge is requested unduly, the cardholder will be liable to GT-MEDICAL SL for compensation for the damages caused as a result of such cancellation.
GT-MEDICAL SL undertakes to deliver the order within a maximum of 24-48 HOURS from the day after the order is placed.
The availability of the products offered by GT-MEDICAL SL may vary depending on customer demand. Although GT-MEDICAL SL updates its stock periodically, the product requested by the customer may be out of stock at that time. In the event of the failure to process the order due to unavailability, GT-MEDICAL SL will notify the customer by email as soon as it becomes aware of this situation. This notification will be made within a maximum period of 30 days. GT-MEDICAL SL may give the double option of: providing the customer with a product of similar characteristics or of superior quality, without a price increase or, unless GT-MEDICAL SL can provide justified and demonstrable reasons within the same period, return the amounts paid for the cancelled order. In the event that GT-MEDICAL SL does not make this payment within the aforementioned period, the buyer may claim payment of double the amount due, without prejudice to their right to compensation.

RIGHT OF WITHDRAWAL, REFUNDS AND COMPLAINTS

The buyer will have a minimum period of 15 calendar days to withdraw, starting from the day on which the customer receives the product, without penalty and without stating the reasons.

The right of withdrawal must be notified by telephone on 913806575, by email at clientes@gt-medical.com, or by sending a letter to our postal address at CAMINO DE HORMIGUERAS, 122 BIS, 3ª PLANTA, NAVES P1 Y P2. 28031 MADRID, or via the cancellation form.

According to the provisions of Article 103 of Law 3/2014 of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users, supplies of services or goods made according to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or are likely to become damaged or expire quickly, are exempt from the right of withdrawal.

RETURNS

The customer must return or deliver the product directly to GT-MEDICAL SL, at the address CAMINO DE HORMIGUERAS, 122 BIS. 3ª PLANTA. NAVES P1 Y P2. 28031, MADRID, without any undue delay, and in any case within a maximum period of 15 calendar days from the date on which the right to withdraw from the contract is formalised. The deadline will be deemed to have been met if the customer returns the product before the end of the deadline.
GT-MEDICAL SL will bear the cost of returning the product in the event that it is in poor condition, which will be verified upon collection. If the product is found to be open, dirty, with residues or any sign of having been used, it cannot be returned. GT-MEDICAL will bear the cost of collection and delivery due to a change of material, provided that the change is the result of an error on our part.

The customer will bear the cost of returning the product, if they wish to do so by their own choice. In this case, the products to be returned must be in perfect condition, unused and in their original packaging. Please make sure that the package is properly protected and sealed to avoid any problems during transport. Once received, we will check its condition. We will check that the item(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition.

If it is within the established period of 15 days from the purchase, the product will be paid for on the same delivery note if it has not yet been invoiced; if it has already been invoiced, a corrective invoice will be generated. In this case, the customer is entitled to a refund if the money has already been paid. After these 15 days, only changes of material or returns can be made. If payment has already been made for the product, the credit will remain on account to be offset against future invoices; in no case will the money be refunded.

After 6 months from the date of purchase, no returns or changes of material will be permitted.

For items that are part of a kit (composed of several parts) that are returned incomplete, the customer will be invoiced for the missing part. The above requirements related to the good condition of the item must always be met.

To return an offer within the deadline, the entire product making up the offer must be returned, even if it is free of charge. If it is not returned, the customer will be charged.

RETURNS OF DEFECTIVE PRODUCTS

If the product is not in good condition for reasons that are not attributable to the customer, the customer will have the right to return the product, informing GT-MEDICAL SL of the reason for the return by any of the means provided in these contract terms and conditions, at no extra cost to the customer. Returns due to defective products or products delivered in a poor condition will not be deemed a right of withdrawal.
GT-MEDICAL SL undertakes to bear the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

REFUNDS

Direct refunds will only be made if the conditions and times established in the return policy have been met, in which case, the refund will be provided through the same means used by the customer for payment. If the time established for the return of the product exceeds the time established in the return policy for refunds, a credit will be generated in favour of the customer that can be applied to future invoices.

NON-OSSEOINTEGRATION GUARANTEE PROTOCOL

  • For the claim to be accepted, it is essential to fill in the implant incident form that can be downloaded from our website, requested from our customer service department or from your local sales representative.
  • The form must be filled in completely, documenting all requested details. Once done, it must be delivered to GT-Medical together with the dental implant. All products must be cleaned and sterilised before being sent to GT-Medical.
  • The customer must be up to date with payments at the time of submitting the form.
  • The customer must have followed the recommendations and surgical protocols established by GT-Medical for the placement of the dental implants.
  • Complaints should be submitted as soon as possible after detection.
  • Once the reports have been analysed, GT-Medical will have five months to replace the non-osseointegrated implant if it is under warranty.

WARRANTY EXCLUSIONS

  • GT-Medical declines all liability, on its own behalf and that of its representatives and third party manufacturers or distributors of its products, for loss of profit, income or earnings as a result of the non-osseointegration of its implants.
  • The warranty will not apply when non-osseointegration is due to trauma, accident or directly caused by the patient or third parties, when it is the result of a clinical component in patients with accepted contraindications as such, including alcoholism, uncontrolled diabetes and drug dependence.
  • The warranty is exclusively for the dental implant and will in no case include other rights, benefits or remedies such as the costs of clinical treatment and laboratory work.

The warranty will not apply to implants if the conditions set out in this warranty protocol are not met.

JURISDICTION

Likewise, GT-MEDICAL SL reserves the right to bring any civil or criminal actions it deems appropriate for improper use of its website and content or for breach of these terms and conditions.
The relationship between the User and the provider will be governed by applicable regulations in Spanish territory. In the event of any discrepancy, the parties may submit their disputes to arbitration or to the ordinary courts in accordance with the applicable rules on jurisdiction and competence. GT-MEDICAL SL is based in MADRID, Spain.

Contracts concluded by electronic means involving the consumer as a party will be deemed to have been concluded at the consumer’s place of habitual residence.
Electronic contracts between entrepreneurs or professionals will, in the absence of an agreement between the parties, be deemed to have been concluded at the registered address of the service provider.
